  • Scheme Amendment No. 37 To City Of Subiaco Town Planning Scheme No. 4

    Public comment is currently being invited on Scheme Amendment No. 37 to City of Subiaco Town Planning Scheme No. 4.

    The purpose of the amendment is to:

    • Rezone and reclassify No. 2 (Lot 13) Upham Street, Jolimont (the subject site), from Civic and Cultural reserve to Commercial/Residential zone and Open Space reserve;
    • Designate a residential density code of R-AC3;
    • Insert provisions into Town Planning Scheme No. 4 that would apply the following development standards to the Commercial/Residential portion of the subject site:
    1. Permit buildings with a maximum plot ratio of 2.0;
    2. Permit buildings with a maximum building height of four...

    Public comment is currently being invited on Scheme Amendment No. 37 to City of Subiaco Town Planning Scheme No. 4.

    The purpose of the amendment is to:

    • Rezone and reclassify No. 2 (Lot 13) Upham Street, Jolimont (the subject site), from Civic and Cultural reserve to Commercial/Residential zone and Open Space reserve;
    • Designate a residential density code of R-AC3;
    • Insert provisions into Town Planning Scheme No. 4 that would apply the following development standards to the Commercial/Residential portion of the subject site:
    1. Permit buildings with a maximum plot ratio of 2.0;
    2. Permit buildings with a maximum building height of four storeys except where development is located within 20m of the eastern boundary, in which case buildings are permitted up to a maximum of two storeys; and
    • Encourage the preparation of a Local Development Plan (LDP) by inserting provisions to allow buildings up to 6 storeys with a plot ratio of 3.0 where consistent with an applicable LDP.

    How to make a submission

    For more information regarding proposed draft Amendment No. 37, including an extract of Council’s minutes, please visit www.haveyoursay.subiaco.wa.gov.au.

    Alternatively, you can view a hard copy of the report for draft Amendment No. 37 at the City’s Administration Centre, 241 Rokeby Road, Subiaco, or at the Subiaco Library, during normal operating times.

    The City’s preferred method of receiving submissions is through this online form.

    Alternatively, if you would prefer to write or email your comments, Form No. 3A can be downloaded from the document library or is available as a hard copy from the City's Administration Centre or the Subiaco Library. You can lodge your submission through email at city@subiaco.wa.gov.au or by letter. When providing a submission through email or letter, please include your name and address, the property affected and details of your submission addressed to The Chief Executive Officer, City of Subiaco PO Box 270, Subiaco WA, 6904.

    To allow the City to carefully consider all responses in a timely manner, submissions need to be received by 5pm Friday 7 September 2018.

    Relationship with draft Local Planning Scheme No. 5

    Public consultation on draft Local Planning Scheme No. 5 (LPS 5) concluded on 13 July 2018 and the City is currently considering the submissions received during the advertising period. Draft LPS 5 was prepared to update planning controls in the City and replace the current Town Planning Scheme No. 4

    The subject site is proposed to be rezoned to Mixed Use under draft LPS 5 which will apply the draft LPS 5 Mixed Use development controls. You can find these development controls in draft LPS 5, which is available on the City’s Have Your Say website: https://www.haveyoursay.subiaco.wa.gov.au/LPS.

    There is no impediment in the progression of draft Amendment No. 37 and draft LPS 5 at the same time, as the planning recommendations for the subject site can be used to inform either or both planning documents.

    Progression of draft Amendment No. 37 may expedite assessment of the proposed new development controls and the proposal to reserve land for public open space. Should draft Amendment No. 37 be finalised prior to draft LPS 5, then the outcome can be used to inform appropriate development controls for the subject site in draft LPS 5.

    If the progression of draft Amendment No. 37 aligns with the timeframe for draft LPS 5, then the information received and analysis undertaken for the Amendment will feed into consideration of the subject site in draft LPS 5.

    What happens next?

    After public advertising concludes, the City will carefully consider each submission and prepare a report to Council, including any recommended modifications in response to the submissions received.

    The resolution of Council, scheme amendment report and all submissions will be forwarded to the WAPC for consideration.

    SCHEME AMENDMENT 32 - CITY OF SUBIACO TOWN PLANNING SCHEME NO. 4

    Notice is hereby given that the following proposed modifications have been made to the above mentioned planning scheme amendment:

    1. Modify the Centre zone to cover the entire Subiaco Activity Centre Plan area.

    2. Zone No. 100 (Lot 12610) Roberts Road, Subiaco (Telethon Site) to Commercial/Residential.

    3. Modify amendments to the centre zone in the land use table to align with the land use permissibility’s applied in the Subiaco Activity Centre Plan.

    4. Amendments to provisions in clause 28 (4) of the Scheme as follows:

    1. To exclude clauses 42(1) and 42(3);

    2. To include the new schedule 9 in the clause; and

    3. To include reference to 45(1)(a) and 45(1)(b) to clarify the application of the clause.

    1. Modify clause 42(2)(b) as it relates to building heights permitted for lots in the Residential zone bound by Roberts Road, Hamilton Street, York Street and Catherine Street to provide for additional height consistent with the draft North Subiaco Structure Plan.

    2. The amendment is modified to insert a new clause 42(5) Residential R-AC0 clause in the Residential Zone section. The following clauses are renumbered accordingly.

    3. Delete subclause 45(1)(b) and replace with a modified provision to apply the intended maximum plot ratio provisions for the Commercial/Residential Zone east of Townshend Road.

    4. Modify clause 45(3) so it applies to land not subject to the North Subiaco Structure Plan.

    5. Modify clause 45(4)(a) so that it applies to land not subject to the North Subiaco Structure Plan.

    6. Delete 45(4)(c) and replace with a modified clause to give effect to building heights set out in the North Subiaco Structure Plan. Insert additional wording to articulate the maximum permissible floor to floor heights of ground/first floors and all levels above the first floor.

    7. Modify the objectives of the Centre zone to identify the need to designate and plan for the development of the land as an activity centre.

    8. Refer all development standards in the centre zone to Schedule 9.

    9. Insert key development standards from the Subiaco Activity Centre Plan into the Scheme, including building height, setbacks and transitional provisions, as ‘Schedule 9.

    10. Remove the proposal to insert Special Control Area provisions into the Scheme.

    11. Remove the proposal to insert Local Development Plan (LDP) provisions into the Scheme.

    12. Modify the proposed new definitions in Schedule 1: Definitions.

    13. Implement of recent modifications to the Subiaco Activity Centre Plan to refer to the existing Schedule 8 of the scheme for any development in relation to the Pavilion Markets Site.

    Notice is hereby given that the local government of the City of Subiaco has prepared the abovementioned town planning scheme amendment for the purpose of amending the City of Subiaco Town Planning Scheme No. 4 to:

    Include new development standards for the land zoned ‘Commercial/Residential’ on the western side of Rokeby Road, between Hamersley and Nicholson Roads, Subiaco. The amendment proposes to introduce provisions that give the City discretion to approve development:

    • With an increased plot ratio of up to 3.0:1 (commercial – 2.0:1 and residential 1.0:1);

    • At a height of up to 18.5m overall and 17.0m wall height, subject to transitional height criteria and the satisfaction of a number of other criteria relating to a cap on storeys (4), gradually increasing rear setbacks to the western boundary, environmental sustainability and street activation.
